Below you will find the Terms and Conditions. These terms apply whenever you place an order through our website and contain important information for you as a buyer. Therefore, please read the Terms and Conditions carefully. We also recommend that you save or print these terms for later reference.

 

Article 1 - Definitions

Gymsetz is a company located in the Netherlands and registered with the Chamber of Commerce under registration number 91337429. It operates under the name Gymsetz. The website of Gymsetz is available at Gymsetz.com, including all related subdomains.
Customer refers to a natural person who does not exercise a profession or business and enters into an agreement with Gymsetz and/or has registered on the website.
Agreement refers to any arrangement or agreement between Gymsetz and the customer that complies with the provisions of the general terms and conditions.
Terms and Conditions refer to the current set of conditions applicable to the services and agreements of Gymsetz.

Article 2 - Applicability of the Terms and Conditions

The Terms and Conditions apply to all offers, agreements, and deliveries from Gymsetz.
If the customer includes terms or conditions in their order, confirmation, or notification that deviate from or are not included in the Terms and Conditions, these will only be binding for Gymsetz if they are explicitly accepted in writing.

 

Article 3 - Prices and Information

The prices listed on the Gymsetz website include VAT and other government levies.
The displayed prices include shipping costs.
Although the content of the website is compiled with great care, Gymsetz cannot guarantee that all information on the website is always complete and accurate. Gymsetz reserves the right to correct prices and other information on the website and in other Gymsetz materials in case of obvious programming and typographical errors.
Gymsetz cannot be held responsible for any (color) discrepancies due to differences in screen quality.

 

Article 4 - Copyright

It is not allowed to copy or use our images for commercial purposes by third parties. The images we use are unique and the exclusive property of Gymsetz. If someone uses our material for commercial use, we will issue an invoice to the respective company. Prices for such use range from €300.00 to €900.00. With permission, images can be used for blogs and other publications, provided that they are for the benefit of Gymsetz.

 

Article 5 - Formation of Agreement

The agreement between Gymsetz and the customer is concluded when the customer accepts the offer from Gymsetz and meets the conditions set by Gymsetz.
If the customer has accepted the offer electronically, Gymsetz will immediately confirm receipt of the acceptance electronically. Until this confirmation is received, the customer has the option to cancel the agreement.
If it turns out that the customer has provided incorrect information when accepting the agreement or in another way, Gymsetz has the right to fulfill its obligations only after the correct information has been received.

 

Article 6 - Execution of Agreement

After receiving the order, Gymsetz will ship the products as soon as possible, taking into account the provisions mentioned in paragraph 3 of this article.
Gymsetz reserves the right to involve third parties in fulfilling its obligations arising from the agreement.
The standard delivery time is usually 1 business day (only for successful transactions before 16:00) and a maximum of 3 business days. The method of delivery can take place in various ways, at Gymsetz's discretion.
Gymsetz advises the customer to inspect the delivered products within a reasonable time and report any defects preferably in writing or by email to support@gymsetz.com, as described in the article on warranty and conformity.
Once the products to be delivered have been delivered to the specified address, the risk related to these products passes to the customer.

 

Article 7 - Right of Withdrawal

If the customer is a natural person who does not act in the exercise of his profession or business, he has the right to cancel the distance agreement with Gymsetz free of charge within 14 days after receiving the product, without giving any reason. The customer only bears the direct costs of returning the product. Any shipping and payment costs the customer has paid for the delivery of the product will be refunded upon return of the full order.
Within the withdrawal period, the customer will handle the product and packaging with care. The customer will only open the packaging and use the product to the extent necessary to assess the nature, characteristics, and functioning of the product.
The customer can cancel the agreement according to paragraph 1 of this article by returning the product within the specified period to Gymsetz, or by notifying Gymsetz within this period of their intention to withdraw from the purchase and subsequently returning the product as soon as possible.
Any amounts paid by the customer in advance will be refunded as soon as possible, but no later than 30 days after the cancellation of the agreement.
The website provides clear information about the applicability of the right of withdrawal and, if applicable, the required procedure before concluding the agreement.
The right of withdrawal does not apply to:

• Products made by Gymsetz according to the customer's specifications;

• Products that are clearly personal in nature.

 

Article 8 - Payment

The customer must make payments to Gymsetz according to the payment methods indicated during the order process on the website. Various payment methods, such as iDEAL, credit card, and/or PayPal, can be used at Gymsetz. However, Gymsetz retains the right to determine which payment methods are offered, and this choice may change from time to time.

 

Article 9 - Warranty and Conformity

Gymsetz guarantees that the products comply with the agreement, the specifications as stated in the offer, reasonable quality and usability requirements, and applicable legal provisions and government regulations at the time of concluding the agreement. If specifically agreed, Gymsetz also ensures that the product is suitable for other than normal use.
Any warranties provided by Gymsetz, the manufacturer, or the importer do not affect the statutory rights and claims that the customer has under the agreement and can invoke.
If the delivered product does not comply with the agreement, the customer must notify Gymsetz within a reasonable time after discovering the defect.
If Gymsetz deems the complaint valid, it will, in consultation with the customer, repair, replace, or compensate the relevant products. The maximum compensation is equal to the price the customer paid for the product. This article does not affect the customer's right to claim damages.

 

Article 10 - Complaint Procedure

If the customer has a complaint about a product (as described in the article on warranty and conformity) or other aspects of Gymsetz's services, they can contact Gymsetz via the email address support@gymsetz.com. Clearly indicate what your complaint is and provide the order number if applicable, so we can resolve your complaint immediately if it is valid.
Gymsetz will respond as soon as possible, but no later than 3 days after receiving the complaint. If it is not possible to provide a full and substantive response at that time, Gymsetz will confirm receipt of the complaint within 3 days and provide an indication of when a substantive or final response can be expected.

 

Article 11 - Personal Data

Gymsetz processes the customer's personal data in accordance with the privacy policy available on the website.

 

Article 12 - Cookies

Gymsetz uses cookies to improve your visit to our website. Cookies are small text files stored by your browser on your computer. They allow us to recognize you and gather information about your visit to our website, so we can improve and adapt our services to your needs. Our cookies do not contain personally identifiable information. You can choose to disable cookies in your browser settings, but please note that this may affect the functionality of our website.

Article 14 - Shipping & Returns

Orders placed before 16:00 will be shipped the same day and, in most cases, delivered the next day if the items are in stock. Products are delivered within 2-3 business days. You have 15 minutes after placing your order to cancel it.

You have 14 days from the moment of receipt to return the product without giving any reason. The full purchase amount, including shipping costs, will be refunded according to the payment method used during ordering. The amount will be credited to your account within 14 days, depending on the chosen payment method, provided the product is received by us in undamaged condition. Return costs are at your own expense; you can request a return label via our website or create one yourself via a carrier of your choice. If you exercise your right of withdrawal, you must return the product with all provided accessories and, if reasonably possible, in its original condition and packaging.

 

Article 15 - Exceptions to Returns

Damaged products cannot be returned. If items are returned with damage, the amount will not be refunded.
Products manufactured according to the consumer's specifications cannot be returned.
Personal products are non-returnable.
Returns are not accepted after 14 days.
A return shipment must be accompanied by a track & trace code. Once we have received the returned items, the purchase amount will be refunded to your account within 14 days.

 

Article 16 - Quality Evaluation Timeframe

After receiving your package in our warehouse, the quality evaluation will be conducted within 48 to 72 hours. Please note that this process may take longer for some products.

 

Article 17 - Replacement Timeframe

If you have opted for a replacement item, you can expect it within 2-4 weeks from the date we receive the tracking information of the returned item and the quality evaluation is complete.

 

Article 18 - Refund Timeframe

Customers who have requested a refund can expect it within 14 days after we receive the returned item.

 

Article 19 - Product Exchange

If you want to exchange a product, please contact us via the contact form on our website. Please note that you are responsible for the cost of returning the product.

 

Article 20 - Incorrect Delivery Address

If you accidentally provided an incorrect delivery address, please contact us as soon as possible. We will do our best to modify the order for you.

 

Article 21 - Warranty

You can rely on us to deliver our products with care, and they will be delivered in good condition. However, if an order gets damaged during transport or something else occurs that entitles you to a warranty claim, contact us within two weeks of discovering the defect, and we will provide repair or replacement free of charge if the defect falls within the warranty.

 

Article 22 - Privacy Policy

Hereby, Gymsetz grants you access to the website www.Gymsetz.com (the Website) and invites you to purchase the offered products. Gymsetz reserves the right to adjust the content or remove parts of the Website at any time without informing you.

 

Article 23 - Limited Liability

Gymsetz strives to regularly update and/or supplement the content of the Website. However, it may happen that the content is incomplete and/or incorrect. Gymsetz reserves the right to cancel transactions that have already been completed. Regarding prices and other product information on the Website, there is a reservation for obvious programming and typographical errors. You cannot make a claim for an agreement with Gymsetz based on such errors.

 

Article 24 - Copyrights

Gymsetz holds all intellectual property rights to these materials. It is not allowed to copy, distribute, or use these materials in any other way without written permission from Gymsetz, unless permitted by law (such as fair use) or otherwise specified for specific materials. Taking images for commercial use is not appreciated and may result in an invoice for at least €300.00. Permission can be requested for the use of images for blogs and other publications.

 

Article 25 - Other Provisions

Gymsetz is entitled to change the Terms and Conditions. The modified conditions will take effect at the time indicated by Gymsetz.
Dutch law applies exclusively to all legal relationships in which Gymsetz is a party, even if the obligations are performed entirely or partially abroad or if the party involved in the legal relationship resides there. The applicability of the Vienna Convention on Contracts for the International Sale of Goods is excluded.
Any disputes related to or arising from offers by Gymsetz or agreements entered into with Gymsetz will be submitted to the competent Dutch court.
